But it's the same as the right to bear arms. What they probably meant is that everyone should have a musket to kill for food and protect their family...but you have to take the good with the bad and accept automatic weapons fall under the same protection.

That actually says Congress shall make no law.It doesn't even prohibit the states.ONLY Congress.




Had you ever studied law P4P in any way, shape or form, or alternatively paid attention in Civics, you would understand the fallacy of your argument.

The Federal government (that would be Congress dear) Cannot make a law regarding religion- that MEANS dear one that the states cannot either.
If a state wishes to amend a FEDERAL law, they can merely make it MORE restrictive. In this case they could make the law forbidding the establishment of religion even tighter- no religious affiliation icons in any public building unless you represent ALL religions equally for example, but they CANNOT make it Less restrictive.
That would be why the CONSTITUTION is the end all and be all of legal argument. And WHY when it needs to be made it more clear- we added AMENDMENTS.

Emm,

That actually makes sense.

A state couldn't create a law to make slavery legal, either...just like they can't make up their own gun bans (see what happened in D.C. a couple weeks ago after the Supreme Court ruling for example).

It's been a while since I've been in school...but your explanation makes sense to me.

SDL, thanks, I haven't been in school for a while, but I like Constitutional Law. Heck I liked studying law.
And I really hate it when somebody tries to use the Constitution incorrectly.
 emoticon We have enough problems using it the correct way.

It seems that P4P needs our understanding and prayers too. He father it seems is very ill and she is probably pretty busy taking care of him and her mother.

So- apology for the ugly thought.

And P4P I do hope that your family is alright and that you are making sure that you are taking care of yourself while taking care of others.

I hate to be repetitive, but I really do think we need some clarification. What the Constitution actually says is this: "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof."
Again the constitution does not prohibit the establishment of religion for religion is already established! The contitution protects the "free exercise" of religion. Of course this has traditionally been interpreted to mean that the federal government is prohibited from adopting any particular religion as an official religion.

I'm not expressing an opinion about this. I'm just saying that if we are going to have a meaningful discussion about the Constitution, we should probably have a correct quotation of it.
